These Terms and Conditions ("Terms") govern your access to and use of the Lynkara platform (the "Service"), operated by Lynkara Ltd, a company incorporated in the United Kingdom ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms.

Eligibility

To use Lynkara, you must be at least 18 years old or the age of majority in your jurisdiction. By using the platform, you confirm that you meet this requirement.

Overview of the Service

Lynkara provides a web-based platform that allows creators ("Creators") to monetize by offering paid one-on-one video calls with their clients ("Clients").

Creator Profiles

Creators may create a public profile containing a personal introduction, availability, pricing, and other relevant information.

Creators are responsible for the accuracy of their profiles and the information provided therein.

Booking and Payment

Clients may browse and book calls through the platform.

Payments are processed securely via Stripe. By using the payment system, you agree to be bound by Stripe's terms and conditions.

Clients may leave a custom message indicating the topic of interest.

Scheduling and Communication

Creators are notified of booking requests and may accept or decline. After accepting, the Creator and Client should use the Chat to agree on a suitable time for the call.

Communication between Clients and Creators regarding scheduling is facilitated within the platform.

Video Call Hosting

Once scheduled, calls are hosted via Lynkara's integrated video service.

Both parties shall access the Lynkara platform at the agreed time and join the Call.

Lynkara is not responsible for technical issues arising from internet connectivity or browser compatibility.

Fees and Payment to Creators

Creators retain the call earnings, less any payment processing fees and platform fee.

Cancellations and Refunds

Cancellation

The Client may cancel a Booking at any time, but if Cancellation occurs after the Creator has approved the booking, no refund is given.

The Creator may decline a Booking request, after which the payment is cancelled and no charge is made on the Client's card.

Once the Creator accepts the meeting, there are no refunds except in the following scenarios:

  • The Creator agrees to a refund
  • In the event that the Creator fails to attend a scheduled meeting and does not make reasonable efforts to reschedule such meeting within a commercially reasonable period, the Client shall be entitled to request a refund, and the Creator shall be obligated to promptly refund the Client.

Cancellations may be mutually agreed upon through candid negotiation between the creator and the client. Any cancellation fee shall be determined by the agreement between the parties.

The platform does not offer a standard refund policy for cancellations, as the fee covers both chat and video interactions between the creator and the client.

Given the subjective nature of these interactions, the platform cannot assess the amount of value already delivered.

In the event of a full refund, Lynkara may waive its platform fee depending on the circumstances; however, Stripe fees will always apply as the are deducted by Stripe at the time of initial payment.

Dispute Resolution

We encourage creators and clients to resolve issues directly with each other through good faith negotiation. If a resolution cannot be reached, please contact us with your booking details and a description of the issue.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to any conflict of law principles.

Any further disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Data Retention

We retain personal data for as long as necessary to fulfill our contractual obligations, comply with legal requirements, resolve disputes, and support legitimate business interests.

Usage logs may be retained for up to 36 months for purposes including analytics and fraud prevention.

Code of Conduct

Users must engage respectfully and professionally.

Any form of abuse, harassment, or inappropriate behavior may result in account suspension or termination.

Prohibition of Abuse

Lynkara maintains a zero-tolerance policy for any form of abuse of the platform. This includes, but is not limited to:

  • The creation, posting, transmission, or distribution of pornographic, sexually explicit, or obscene content;
  • Harassment, threats, stalking, or any conduct intended to intimidate, bully, or harm any person;
  • The promotion or facilitation of violence, self-harm, or any illegal activities.
  • Dishonest representation, such as pretending to be someone else.

Any violation of this policy may result in immediate suspension or termination of your account, removal of content, and potential reporting to law enforcement authorities, in Lynkara's sole discretion.

Intellectual Property

All content provided on the platform, excluding user-generated content, is the property of Lynkara and may not be copied or used without permission.

Creators retain ownership of their uploaded profile content.

Disclaimer of Warranties

Lynkara provides the Service "as is" and makes no warranties regarding the quality, availability, or reliability of video calls.

Lynkara does not guarantee the accuracy or usefulness of advice given during calls.

Limitation of Liability

To the fullest extent permitted by law, Lynkara shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Service.

Termination

We reserve the right to suspend or terminate access to the platform for any user who breaches these Terms.

Modifications to the Terms

We may update these Terms from time to time. Continued use of the platform after changes indicates acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.
